Tennessee Titans Kickoff Extravaganza Experience
Description
The winning bidder and one guest will arrive at Adelphia Coliseum with credentials that provide field access for the Kickoff Game on Sunday Night September 9th against the Dolphins. The night will begin on the field level, with a close-up view of warm-ups and the pre-game activities. After the opening kickoff (if the Titans Kickoff the First Half), the winning bidder will run onto the field in front of 68,000 fans to retrieve the kicking tee. Once this moment in the spotlight is complete, the game will be enjoyed from two club-level seats between the 30’s. And, as a special memory, the winning bidder will also keep the football used for the kickoff as the ultimate souvenir of this experience.

This Experience, which takes place on Sunday September 9th, includes the following elements:

  • Behind-the-scenes tour of Adelphia Coliseum, including stops at the owner’s suite, stadium club, post-game media interview room, ESPN production area and press box. Note: Field Access can only be given to those over 12 years of age. Note: Field Access can only be given to those over 12 years of age.
  • On-field opportunity to watch warm-ups and the pre-game Sunday Night festivities
  • Two club-level tickets between the 30’s ($249.50 Face Value)
  • An official game-used "K" football
  • Once-in-a-Lifetime opportunity for one person to retrieve the tee following Titans kickoff
  • One stadium parking pass


Notes: Winning Bidder will have the opportunity to retrieve the Tee from either the first or the second half based on which half the Titans Kickoff. Due to National Football League regulations, entry into the locker rooms is not permitted. The Titans require compliance with their “no autograph” policy during the tour. Video and still photography are allowed and encouraged

Terms

By bidding on any Experience (as hereinafter defined) auctioned by the National Football League ("NFL") on eBay (http://www.ebay.com) (each such Experience an "NFL Auction"), the person or entity making such bid ("Bidder") agrees to be bound by this Agreement. This Agreement may be changed by the NFL at any time without notice; the most current version (as noted in the effective date above) will apply.

Bidder and the NFL agree to be bound by the following provisions:

  1. Adoption of Agreement. By bidding on an NFL Auction, Bidder agrees to all terms and conditions of this Agreement. This Agreement contains the "conditions of sale" referred to in Section 4 of the eBay User Agreement. Bidder makes all bids either (i) on his/her own behalf or (ii) on behalf of another entity or person, in which case Bidder warrants that Bidder is legally authorized to enter into the Agreement for the entity or person for whom Bidder is acting and that Bidder’s actions will legally bind that entity or person, as will this Agreement.
  2. Definitions. In this Agreement, the following definitions shall apply: "Experience" shall mean the ability for an individual(s), as part of a program organized and arranged by the NFL, its Member Clubs, and/or third-party service providers contracted by the NFL, to personally participate in one or more events and/or activities to which access is not regularly available to the general public, and included in which may also be a Collectible(s) and a Ticket(s) as hereinafter defined. "Collectible" shall mean one or more pieces of personal property that are reasonably considered to be distinctive for some reason other than their normal use (e.g., contains an autograph or has been used by a particular person with celebrity status). "Ticket" shall mean a ticket that grants an individual admission to an NFL football game or other NFL-related event, access to which is controlled by distribution of tickets and limited only to ticket holders.
  3. Bidding Conditions. The description of each NFL Auction as presented in the eBay listing advertising the availability of such NFL Auction contains all information necessary to provide Bidder with an accurate description of it. Any items or elements not expressly listed in such description are excluded. All Experiences are also subject to the following conditions: (i) the NFL warrants that, to the NFL’s knowledge, the description of an Experience is accurate in all material respects and not misleading based upon a fair reading of all the details relating to such description when taken as a whole; (ii) the NFL reserves the right to make substitutions of equal or greater value for all or part of any Experience, if any part becomes unavailable as described. All such determinations will be made by the NFL in its sole discretion. Bidder agrees that any such substitution shall satisfy the NFL’s obligation to Bidder; (iii) Experiences may be rescheduled. Bidder agrees to adjust Bidder’s schedule accordingly and further agrees that any rescheduled Experience shall satisfy the NFL’s responsibility to provide such Experience; (iv) Experiences are subject to the terms and conditions of any event that is part of the Experience; (v) participation in Experiences that might result in personal injury to Bidder or others is subject to execution by the participants of a liability release, as provided by the NFL, which shall relieve the NFL of any responsibility or liability for any claim arising in connection with the Experience; (vi) participation in an Experience may be premised upon on execution of the release referenced in this Section 3 and upon participation in, and clearance under, a background check to NFL’s satisfaction in its sole discretion; by bidding, Bidder consents to such a background check, if required by the NFL; (vii) Collectibles are not provided or intended for ordinary use and may not be new; (viii) Bidder acknowledges that the value of any Ticket that is a component of an Experience is no greater than the face value of such Ticket, and that any amount paid by Bidder for such Experience that is above the face value of such Ticket is a fair value for the other element(s) of such Experience; (ix) if the NFL does not receive payment within five business days of completion of an NFL Auction, the NFL may suspend or cancel Bidder’s interest in such NFL Auction without further notice and make the same available to another bidder; and (x) the NFL may, in its sole discretion, elect to verify bids while an NFL Auction is underway and bids that cannot be so verified may be cancelled.
  4. Restrictions on Transfers of this Agreement and Experiences. Bidder’s rights under this Agreement may not be assigned, transferred, re-marketed, or otherwise disposed of in any manner without NFL’s prior written consent, which may be withheld for any reason. All rights apply only to Bidder and/or other persons acceptable to NFL (in NFL’s sole discretion) that Bidder designates and submits to NFL in writing at the time of payment. For anyone to participate other than Bidder, Bidder must indicate the relationship between Bidder and the proposed participant and comply with NFL’s applicable procedures for changing participant. Any unauthorized attempt to transfer, assign, re-market or otherwise dispose of Bidder’s rights in any manner will void all such rights.
  5. Appropriate Bidder Conduct. Bidder agrees to behave in an appropriate manner at all times with respect to participation in an Experience. Bidder agrees to comply at all times with all applicable laws and all directives made by NFL and/or Member Club staff or their representatives.
  6. Indemnification. Bidder agrees that Bidder will not take, or directly or indirectly cause to be taken, any action that might offend, harm or adversely affect the reputation, well-being, physical integrity, security, or legal or other rights of others or disrupt the conduct of an NFL game or other event. Bidder agrees to defend, indemnify, and hold harmless the NFL, its Member Clubs, and all persons who engage in Experience in which Bidder or Bidder’s designee(s) participates or a Collectible which Bidder or Bidder’s designee(s) acquires, and each of their respective directors, officers, employees and agents of all of the foregoing, from and against all losses, damages, harm, claims and expenses arising out of or relating to (i) breach of this Agreement by Bidder or any designee of Bidder’s, (ii) the conduct of Bidder or Bidder’s designees with respect to an Experience, and (ii) the violation of any laws or the rights of any of the foregoing or any third party.
  7. No Incidental, Consequential or Certain Other Damages. To the full extent allowed by law, Bidder agrees that neither NFL nor any Member Club nor employee will be liable to Bidder and/or any other person for any consequential or incidental damages or any other indirect, special, or punitive damages whatsoever that arise out of or are related in any way to any Experience, other service, Collectible, or details regarding any of the foregoing, any breach of this Agreement, or any web site relating to any of the foregoing, cancellation of listings, or withdrawal of acceptance of a bid , even if the aforementioned parties have been advised of the possibility of such damages and even in the event of fault, tort (including negligence) or strict or product liability.
  8. Limitation of Liability and Exclusive Remedy. Bidder agrees that Bidder’s sole remedy for any breach of this Agreement by the NFL or any of the NFL’s affiliates or agents shall be, at the NFL’s option: (i) substitution or replacement of all or part of the Experience that gives rise to damages incurred by Bidder in reasonable reliance on the NFL; or (ii) refund of the amount that Bidder paid for the Experience. Bidder agrees that the damage exclusions in this Agreement and this limitation of liability shall apply even if any remedy fails of its essential purpose. Some states do not allow the limitation of liability, so the foregoing limitation may not apply to certain Bidders.
  9. Bid Acceptance and Payment. Any accepted bid will be deemed to have been accepted by the NFL in New York, New York on the terms and conditions of this Agreement and the description of the NFL Auction. Bid acceptance is subject to verification that the credit card Bidder designates for payment is valid and has a sufficient credit limit to cover the full amount due. Bidder may pay the final bid amount by charging it to a valid credit card that is acceptable to the NFL or providing a personal check, bank check, or money order. Personal checks require ten (10) business days to clear. If payment is made by credit card, Bidder promises to pay, and authorizes the NFL to charge, the amount of any bid of Bidder’s that is accepted, plus all applicable taxes, shipping and handling charges, and all other amounts that Bidder may owe under this Agreement to the credit card that Bidder designates. Bidder further agrees that the NFL may require payment on or after the date of acceptance, even though Bidder will not be able to participate in the Experience until the date specified for it in its description.
  10. No Refunds. No refunds will be made with respect to an Experience unless such Experience involves an event for which a refund is provided by the event sponsor to the NFL. The amount of any such refund received by the NFL will be passed on to Bidder, which amount may be less than Bidder paid. No other form of refund is available.
  11. Charitable Purpose Disclosures. Some of the proceeds of an NFL Auction may go to charity. Such instances will be noted in the auction description and advertisement on eBay. NFL makes no representation as to the individual deductibility of contributions.
  12. Force Majeure. If performance of any Experience or obligation under this Agreement is prevented, delayed, restricted or interfered with by events or causes beyond the NFL’s reasonable control, the NFL shall be excused from the performance of such to the extent of the prevention, delay, restriction, or interference. Bidder agrees that if such factor(s) prevents Bidder from participating in an Experience, the NFL is not obligated to provide or re-create the Experience.
  13. Entire Agreement. This Agreement constitutes the entire agreement between Bidder and the NFL. If any provision of this Agreement is found to be invalid, the remaining provisions shall remain in full force and effect.
  14. Jurisdiction. This Agreement shall be governed by the laws of the State of New York without regard to conflict of law provisions. Any disputes arising under or related in any way to any of the foregoing shall only be litigated, arbitrated or otherwise heard in the appropriate forum in the State of New York.
